Terms of Service

1. Acceptance of Terms

By accessing or using FlashQR (“the Service”) at flashqr.io, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all visitors, users, and anyone else who accesses the Service.

2. Description of Service

FlashQR is a QR code management platform that allows users to create, customize, and track static and dynamic QR codes. Features include scan analytics, custom design options, and multiple content types (Website, vCard, Email, SMS, Text, and WiFi). The Service is provided on a subscription basis following a 15-day free trial.

3. Accounts and Registration

You must register for an account to use the Service. You agree to:

• Provide accurate and complete registration information
• Keep your password confidential and not share it with others
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You must be at least 16 years old to create an account. We reserve the right to refuse registration or cancel accounts at our discretion.

4. Free Trial

New accounts receive a 15-day free trial with access to up to 3 QR codes and core features. No credit card is required to start the trial. At the end of the trial period, your QR codes will become inactive unless you subscribe to a paid plan. We reserve the right to modify or discontinue the free trial at any time without notice.

5. Subscriptions and Billing

5.1 Plans

Paid plans (Basic at $9/month, Pro at $29/month) are billed monthly in advance. Plan features and pricing are described on our pricing page and may be updated with notice.

5.2 Payment

Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. All fees are exclusive of taxes, which may be added where applicable.

5.3 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods, except where required by applicable law.

5.4 Plan Expiration

If a subscription lapses or is cancelled, your QR codes will be deactivated. Your data will be retained for 30 days, during which you may reactivate by subscribing again. After 30 days, data may be permanently deleted.

6. Acceptable Use

You agree not to use the Service to:

• Distribute malware, viruses, or any malicious code
• Link to phishing sites, scam pages, or illegal content
• Violate any applicable local, national, or international law or regulation
• Infringe any intellectual property rights of others
• Spam, harass, or deceive end users who scan your QR codes
• Collect personal data from QR scanners without their consent
• Attempt to reverse engineer, hack, or disrupt the Service or its infrastructure
• Resell or sublicense the Service without our written permission

We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.

7. Intellectual Property

Your content: You retain ownership of all content you upload or create through the Service (QR code names, destination URLs, vCard data, etc.). You grant FlashQR a limited, non-exclusive license to store and process this content solely to provide the Service.

Our platform: FlashQR and all related logos, software, design, and documentation are the intellectual property of FlashQR. Nothing in these Terms transfers any ownership of our intellectual property to you.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that QR code redirects will be available at all times or that analytics data will be 100% accurate.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLASHQR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless FlashQR and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us or deleting your account from the settings page. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FlashQR operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
